A Utah man has been sentenced after admitting responsibility in the fatal stabbing of his neighbor following a night of drinking that turned violent. The case, which took place in Cedar City, involved two neighbors who had been drinking together before an argument escalated into a deadly confrontation. The court ultimately accepted a plea deal that reduced the original charge.
Utah Man Pleads Guilty in Neighbor’s Fatal Stabbing
Gerald Vandermeer, 57, pleaded guilty to homicide by assault in connection with the death of his neighbor, 45-year-old Cory Whittenburg.
The incident occurred on February 12, 2025, in Cedar City, Utah. Vandermeer was originally charged with first-degree murder, but the charge was reduced as part of a plea agreement.
According to court reports, Vandermeer and Whittenburg were neighbors who had spent the evening drinking together before the situation turned violent.
Night of Drinking Led to Deadly Argument
Authorities said Vandermeer went to Whittenburg’s home that day carrying a bottle of vodka and a case of beer.
During the sentencing hearing, Vandermeer’s defense attorney said both men were drinking heavily and had also used THC.
At some point during the night, the two men got into an argument that escalated into a physical fight.
Investigators later said Vandermeer told them he could not remember what the argument was about due to the heavy drinking.
Police Found Victim Dead From Multiple Stab Wounds
Law enforcement officers were called to the home after receiving reports of a stabbing and a gunshot.
When officers arrived, they first encountered Vandermeer outside the residence.
Police noted that he had several injuries, including cuts on his face and hands.
Inside the home, officers found Cory Whittenburg dead from multiple stab wounds.
Authorities reported that two of the most severe stab wounds were located in the victim’s back.
Defense Says Defendant Was Traumatized and Intoxicated
During the sentencing hearing, Vandermeer’s defense attorney, Richard Gale, argued that his client was not thinking clearly after the fight.
He said Vandermeer was in a deeply traumatized mental state after the violent encounter.
According to Gale, several factors contributed to Vandermeer’s condition at the time:
- Heavy alcohol consumption
- THC use
- Physical injuries from the fight
The attorney also said Vandermeer suffered stab wounds and a broken ankle during the altercation.
Gale admitted that Vandermeer’s delay in seeking help for Whittenburg was concerning but argued it happened because his client was overwhelmed and not in the right state of mind.
Prosecutor Emphasizes Loss of Life
Prosecutor Shane Klenk reminded the court that the case involved the loss of a human life.
He told the judge that Cory Whittenburg died as a result of a violent confrontation with Vandermeer.
Klenk also pointed out that Vandermeer did not immediately seek help after the stabbing.
Instead, the victim was left alone at the scene.
The prosecutor argued that this decision played an important role in determining the appropriate punishment.
Court Sentences Vandermeer to Prison
After reviewing the case and the plea agreement, the court sentenced Gerald Vandermeer to a maximum of five years in prison.
The sentence includes credit for time already served while the case was pending.
In addition to the prison term, Vandermeer was ordered to pay $5,800 in restitution to help cover funeral expenses and related costs.
