A newly married woman from the United States has taken legal action after what she claims was a wrongful arrest just a day after her wedding. The case has raised serious questions about police procedures and how DUI (driving under the influence) cases are handled.
Newlywed Files Lawsuit Over DUI Arrest
Brianna Longoria, an aspiring nurse from California, has filed a lawsuit against the Phoenix Police Department after she was arrested for alleged DUI in Phoenix.
The incident happened in December 2024, just one day after her wedding. She had travelled to Arizona so her ill father could attend her marriage ceremony.
Traffic Stop Led to Arrest
While driving with her husband in a rented car, Longoria was stopped by a police officer who claimed she had run a red light and had a faulty tail light. During the stop, she was asked to perform several tests, including:
- Eye test
- Walking test
- Breathalyzer test
According to reports and body camera footage, Longoria passed the breath test with “triple zeros,” meaning no alcohol was detected.
Arrest Despite Negative Test Results
Even after the negative alcohol result, the officer suspected that Longoria might be under the influence of marijuana. She was then arrested for DUI based on physical observations like red eyes and pupil size.
However, this decision has been strongly challenged in the lawsuit.
Lawsuit Claims False Arrest and Misconduct
Longoria’s legal complaint alleges that the arrest was unfair and not based on proper evidence. It also claims that:
- The officer may have given incorrect details about her condition
- Field sobriety test results were possibly misrepresented
- There may be pressure on officers to make DUI arrests
Bodycam footage reportedly captured a conversation between officers discussing the need to make DUI arrests, which has added to the controversy.
Charges Later Dropped
After her arrest, Longoria was released within hours, but her driving licence was suspended. Later:
- A judge reinstated her licence
- All charges were dismissed in April 2025
- Blood tests came back negative for both alcohol and drugs
Despite this, Longoria says the arrest has had a lasting impact on her life.
Impact on Her Life and Career
The lawsuit claims that the incident caused serious personal and professional problems for Longoria:
- Delay in her cancer treatment due to lack of transport
- Disruption in her studies
- Damage to her goal of becoming a nurse
- Financial burden due to legal expenses
- Cancellation of her honeymoon
She is now seeking compensation and wants the arrest record removed completely.
Police Response and Ongoing Review
The Phoenix Police Department has denied having any DUI quotas. Officials stated that officers are trained to act based on their observations and overall situation.
The department also confirmed that the officers involved are still employed, and the case is currently under internal review.
