A Sherman man who was detained on suspicion of stabbing a man inside his ex-wife’s house in the summer of 2025 will not go to jail.
The charges against Emilson De Dios Escobar, 29, included assault with a deadly weapon.
The other charges were dropped after he entered a guilty plea to one.
He received a five-year probationary period and community service.
“Often times, in cases like these involving domestic violence, the face of the case changes during post-indictment investigation, where more facts and circumstances are learned that mitigate the offense. The incident was between the defendant and his ex-wife, who shared a child. The wife lived apart from the defendant with her new boyfriend. An argument ensued between the defendant and his ex-wife when the defendant returned the child from visitation. The argument led to a physical altercation between the defendant and the ex-wife’s boyfriend. The defendant sustained multiple and several significant injuries to his head and face as a result of that altercation. Neither the wife nor the boyfriend were injured. At one point during the altercation, the defendant obtained a knife from the kitchen and threatened the boyfriend after the defendant had sustained several injuries. When police arrived, they found the defendant and the boyfriend in the front yard, where the boyfriend was on top of the defendant still beating him. It was also learned that the wife has a pending family violence charge where the defendant is the victim. In this case, the wife and the boyfriend were consulted about resolving this case, and they agreed that probation was the appropriate resolution. After spending six months in jail, as a result of their consent, the defendant pled guilty to aggravated assault with a deadly weapon, received five years probation, and is required to have no contact with the wife or the boyfriend.”
